The words of which the initial letter is capitalised have meanings defined below. These definitions shall have the same meaning regardless of whether they appear in singular or in plural.

ApplicationRefers to CutisKart, the software program provided by the Company, available on Android and iOS.

CompanyReferred to as "CutisKart", "We", "Us", or "Our" — Cutis Pharma, a unit of Cutis, registered office at 5/1, 4th Main, MRCR Layout, Vijaynagar, Bengaluru, Karnataka 560040.

CountryRefers to: Karnataka, India.

DeviceAny device that can access the Service such as a smartphone, computer, or digital tablet.

ServiceRefers to the CutisKart mobile Application and Website collectively.

Terms of ServiceThese Terms of Service that form the entire agreement between You and the Company regarding the use of the Service.

You / UserThe individual accessing or using the Service, or the company or legal entity on behalf of which such individual is accessing the Service.

Doctor / Registered Medical PractitionerAny person permitted to practice medicine by the MCI (Medical Council of India) or any regional council, duly authorised by the government and verified by us.

Acknowledgment ▼

These are the Terms of Service governing the use of this Service and the agreement that operates between You and the Company. These Terms set out the rights and obligations of all users regarding the use of the Service.

Acceptance of Terms Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

Agreement By downloading and installing this App or visiting the Website, you are bound by these Terms of Service. By accessing or using the Service You agree to be bound by these Terms. If You disagree with any part of these Terms, then You may not access the Service.

Creating an Account ▼

To use certain features of the Website/App — including ordering products, posting ratings and reviews, and receiving CutisKart newsletters — you must create a CutisKart Account and provide accurate registration information.

1.1 Registration To set up an account, you will be asked to provide your name, gender, email address, mobile phone number, and billing/shipping address. All registration information is protected by our Privacy Policy.

1.2 Accuracy of Information You represent and warrant that all information submitted during registration is truthful and accurate, and that you will maintain the accuracy of such information.

1.3 Account Security Your CutisKart Account username and password are personal to you. You may not transfer your account. You are responsible for all activities carried out under your account.

1.4 Unauthorised Access CutisKart will not be liable for any loss or damage resulting from your failure to maintain the confidentiality of your account credentials. If you suspect any unauthorised use of your account, notify us immediately.

1.5 Email Updates It is your responsibility to keep your email address up to date on your account so we can communicate with you electronically.

1.6 Communications Consent By creating an account, you consent to receive transactional and promotional communications via email, telephone, SMS, and chat. To opt out, please notify us by email at contact@cutiskart.com.

2.2 Confidentiality We understand the privacy of all information you provide is of primary importance. We do everything possible to use it carefully and sensibly. This information is never shared with other companies or third-party service providers without your consent.

Communications ▼

By using this Website/App, you consent to receiving calls, auto-dialed messages, and pre-recorded calls from us using the telephone number you provided. This consent covers:

Transactional communications — order confirmations, delivery updates
Promotional emails and SMS messages
Clarification calls and marketing calls
Contacts made through information provided by third parties

Opting Out If you wish to stop receiving communications, send an email to contact@cutiskart.com. You may also be contacted by Service Providers engaged under contract with us, solely in furtherance of their respective agreements.

We will not give out your contact information to third parties not connected with the Website/App or not in furtherance of the activities and aims of the Company.

Customer Membership / Eligibility ▼

Membership and usage of the Website/App is restricted to:

Persons above 18 years of age
Emancipated minors with legal parental or guardian consent
Persons who are legally competent to enter into binding agreements under the Indian Contract Act, 1872

Account Responsibility You are solely responsible for protecting the confidentiality of your username and password. All activity under your account will be deemed to have been carried out by you.

Suspension & Termination If you provide false or inaccurate details, or if the Company has reasonable grounds to believe you have done so, we reserve the right to suspend your account and/or terminate this Agreement without notice and without liability.

Use License ▼

Permission is granted to temporarily use CutisKart's services for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title.

Under this license you may NOT:

Modify or copy the materials
Use the materials for any commercial purpose or public display
Attempt to reverse engineer any software contained on the platform
Remove any copyright or other proprietary notations from the materials
Transfer the materials to another person or mirror on any other server

Termination of License This license shall automatically terminate if you violate any of these restrictions and may be terminated by the Company at any time. Upon termination, you must destroy any downloaded materials in your possession, whether in electronic or printed format.

User Responsibilities ▼

Users of the CutisKart platform are responsible for:

Providing accurate and complete information at all times
Maintaining the security of their account credentials
Using the Service in compliance with all applicable laws
Notifying us immediately of any unauthorised use of their account
Not sharing account credentials with any other person
Ensuring all information submitted (including addresses) is valid and correct
Taking responsibility for all activities that occur under their account

Breach of Responsibilities Failure to comply with these responsibilities constitutes a breach of these Terms, which may result in immediate termination of your account without notice.

Prohibited Uses ▼

You may NOT use the CutisKart Service:

In any way that violates any applicable national or international law or regulation
To transmit or procure the sending of any unsolicited advertising or promotional material
To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
In any way that infringes upon the rights of others, or is illegal, threatening, fraudulent, or harmful
To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
To upload or transmit viruses or any other malicious code
To collect or harvest personal data about other users without their consent
For any purpose that is unlawful or prohibited by these Terms

Our Service allows You to post, share, and make available certain information, text, graphics, reviews, or other material ("Content"). You are responsible for the Content that You post, including its legality, reliability, and appropriateness.

License to Use Your Content By posting Content to the Service, You grant Us the right and license to use, modify, publicly display, reproduce, and distribute such Content on and through the Service to improve and operate our platform.

Your Rights You retain all rights to any Content You submit, post, or display on or through the Service. You are responsible for protecting those rights.

Content Standards Content must not be false, misleading, defamatory, offensive, or in violation of any third-party rights. We reserve the right to remove any Content that violates these standards.

The Service and its original content, features, and functionality are and will remain the exclusive property of Cutis Pharma and its licensors.

Protection The Service is protected by copyright, trademark, and other laws of India and foreign countries. Our trademarks, logo, and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

Restrictions You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from the Company.

Termination ▼

Termination by Company We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason, including without limitation if You breach these Terms of Service.

Effect of Termination Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Termination by User If You wish to terminate Your account, You may request account deletion from within the App under Settings → Delete Account. Your data will be permanently deleted within 90 days.

Limitation of Liability ▼

To the maximum extent permitted by applicable law, in no event shall CutisKart, Cutis Pharma, or its directors, employees, partners, agents, suppliers, or affiliates be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, revenue, data, goodwill, or other intangible losses
Any damages resulting from your access to or use of (or inability to access or use) the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorised access, use, or alteration of your transmissions or content

Maximum Liability The entire liability of the Company under any provision of these Terms shall be limited to the amount actually paid by You through the Service in the 3 months preceding the event giving rise to the claim.

The information on this Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied.

No Warranties To the fullest extent permitted by law, the Company excludes all representations, warranties, conditions, and terms relating to our Service and the use of this Service, including without limitation any warranties implied by law of merchantability, fitness for a particular purpose, or non-infringement.

Medical Disclaimer CutisKart products are dermatologist-backed but do not constitute medical advice. Always consult a qualified dermatologist or physician for medical concerns. Product results may vary by individual.

        ⚠️ CutisKart does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Disputes Resolution ▼

Informal Resolution First If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company at contact@cutiskart.com. We will make reasonable efforts to resolve the dispute within 30 days.

Formal Proceedings If the dispute cannot be resolved informally within 30 days, either party may initiate formal proceedings. Any dispute shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

Governing Law These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Governing Law & Jurisdiction ▼

Applicable Law These Terms and Conditions shall be governed by and construed in accordance with the laws of India.

Jurisdiction Any dispute arising out of or in connection with these Terms — including disputes relating to their validity, interpretation, performance, or enforcement — shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.

App Updates You understand that the App downloaded onto your phone or tablet is owned by us. We may automatically upgrade the App and these Terms shall apply to all upgrades. We reserve the right to terminate this Agreement without notice and suspend your account without assigning any reason.

This document is an electronic record in terms of the Information Technology Act, 2000 and is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.

Changes to These Terms ▼

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time.

Notice of Changes If a revision is material, We will make reasonable efforts to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

Continued Use By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, please stop using the Service.
